Terms of use
Last updated: 29 September 2026
These terms govern the use of Ochrine (ochrine.com), the social network for artists, galleries and collectors. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
Sections 1 to 9 apply to everyone. After them come three sections with the rules specific to each role: artists, collectors and galleries. If you act in more than one role, every matching section applies to you.
1. Who can use it
You must be of the age of majority in your country of residence to create an account. If you are a minor, you may only use the platform with the consent of whoever is legally responsible for you.
You may not use the service for unlawful purposes, nor break the law of your jurisdiction — including copyright law.
2. Your account
You are responsible for keeping your account details accurate and for safeguarding your password. Tell us immediately if you suspect someone else has accessed your account.
You can close your account at any time, from the platform itself. Closing it does not erase records we are required by law to keep, nor does it undo transactions already completed.
3. Your work stays yours
The artworks, images and texts you publish remain yours. We claim no ownership over anything you upload.
By publishing, you grant Ochrine a non-exclusive licence to store, display and distribute that content within the platform — including in listings, search results and shared previews — solely to operate the service. The licence ends when you remove the content, except for cached or backup copies that take some time to expire.
You warrant that you hold the rights to what you publish and that publishing it does not infringe anyone else's rights.
4. Conduct
You may not use the platform to:
- harass, threaten, defame or discriminate against anyone;
- publish someone else's work as your own;
- publish work generated by artificial intelligence. The platform is for work made by people;
- send malicious code or attempt to bypass the service's security;
- harvest other users' data by automated means;
- impersonate another person or organisation.
We may remove content or close accounts that breach these terms.
5. What Ochrine does in a sale
Ochrine is an intermediary. When a work is sold through the platform, or through gallery partner platforms such as Pice Gallery, we process the payment and hold the amount until the conditions described in each role's section are met.
If a collector and an artist deal directly with each other, outside the platform, Ochrine does not step in and takes no responsibility whatsoever — not for payment, not for delivery, not for the condition of the work, and not for any dispute between the parties.
Ochrine does not ship artworks and is not a party to any shipping contract. Shipping is always between the sender, the recipient and the chosen carrier.
6. Paid plans
There is a free plan. Paid plans are billed per period and renew automatically until cancelled. You can cancel at any time; access continues until the end of the period already paid for.
7. Referral programme
Artists, galleries and partners enrolled in the programme earn a commission on qualified referrals.
Payments are made between the 1st and the 10th of each month and always cover the commissions qualified in the previous month.
When the commission currency differs from the currency you are paid in, the conversion uses the exchange rate of the day the commission was qualified, not the rate on the payment date.
Example: a commission qualified on 10 August in EUR, for a partner paid in USD, is converted at the 10 August rate — even though the payment only goes out between 1 and 10 September.
8. Service provided "as is"
We do not guarantee that the service will be uninterrupted or error-free. We may change, suspend or discontinue features.
To the extent permitted by law, Ochrine is not liable for indirect, incidental or consequential damages arising from use of the service.
9. Third-party links
The platform may contain links to third-party sites we do not control. We are not responsible for the content or the practices of those sites.
10. Terms for artists
10.1. Receiving payment for a sale
When your work sells through the platform, the amount is held until the buyer confirms the work arrived in good condition. Once that confirmation comes in, we release the payment.
You must post the work within 5 business days of payment and enter the tracking number on the platform. If the buyer neither confirms receipt nor reports a problem within 30 days of the work being posted, we release the payment automatically.
A released payment is transferred to the account on your profile within 5 business days. While a claim about the work is open, the payment stays held until Ochrine decides.
10.2. Shipping insurance is mandatory
Insurance is mandatory when shipping any work sold through the platform.
If you do not take out insurance and the work reaches the buyer damaged, Ochrine is not liable for the loss. The risk is yours.
10.3. Returns
Where a return happens, the cost of return shipping is paid by the buyer. Ochrine does not cover shipping costs in either direction.
10.4. Applying to exhibitions
An exhibition entry fee is non-refundable once paid.
Payment must be made within 7 days. After that period without payment, the slot is released and the work leaves the exhibition.
10.5. Direct sales
If you sell directly to a collector, outside the platform, that sale does not go through us: we do not hold the funds, do not act as intermediary and take no responsibility for anything related to it.
11. Terms for collectors
11.1. Confirming receipt
After receiving the work, you confirm on the platform that everything is in order. That confirmation is what releases the payment to the artist or gallery, so please confirm as soon as you have checked the work.
If you neither confirm nor report a problem within 30 days of the work being posted, the payment is released to the artist automatically.
11.2. Problems with the work
If the work arrives damaged, never arrives, or is not as described, report a problem on the order page. You can do so from payment and up to 14 days after confirming receipt, as long as the payment has not yet been transferred to the artist.
Opening a claim holds the payment, and the Ochrine team joins the order's conversation to look into it. If the claim is upheld, what you paid is refunded; the work is not exchanged, since each piece is unique. A change of mind is not grounds for a claim.
11.3. Returns
If the work needs to be returned, the cost of return shipping is yours.
11.4. Shipping
Ochrine is not responsible for shipping in either direction. What we do is act as intermediary for the payment of a sale made through the platform.
11.5. Buying directly
If you buy directly from an artist, outside the platform, Ochrine neither intermediates nor takes responsibility for anything — payment, delivery, authenticity or the condition of the work.
12. Terms for galleries
12.1. Ochrine commission
Ochrine only charges a commission when the sale is made through the platform. In that case we deduct 15% of the sale value.
On sales the gallery makes elsewhere, the commission is entirely the gallery's and Ochrine charges nothing.
12.2. Exhibitions
A gallery may publish exhibitions on the platform. On sales made through the platform we deduct the same 15%; on all others, nothing.
12.3. Payout period
The amount due to the gallery is sent within 7 days.
12.4. The gallery's own conditions
The gallery sets the conditions of its own open calls, including an entry fee where one applies. The exhibition itself is the gallery's responsibility, not Ochrine's.
13. Changes
We may update these terms. The version in force is always on this page, with the date of the last change at the top. Continuing to use the service after a change means accepting it.
14. Governing law
These terms are governed by Brazilian law.
